Illegal invasion: Police Slammed N6M Fine By Osun State High Court in Osogbo For Invading A citizen's Resident At About 3AM.

The Osun State Police Command has been ordered to pay the sum of N6 million in restitution by an Osun State High Court in Osogbo for violating the fundamental human rights of two applicants.

Yusuf Adepoju and Muddathir Kewudirorun are the two applicants.

In his ruling for case number HOS/ M. 157/ 2021, Justice A. Oyebiyi stated that the applicants had established their case against the respondent.

The petitioners claimed that on November 16, 2021, at around 3:00 a.m., the Police broke into their private dwellings without their permission for an unclear cause.

The applicants have established their case beyond a reasonable doubt and in their favour, according to Justice Oyebiyi's ruling.

According to the judge, it is unlawful to violate the fundamental rights of unarmed individuals in violation of the Federal Republic of Nigeria's 1999 Constitution as amended.

He explained that the police had compromised the applicants' privacy and the safety of their families by conducting such nighttime raids.

While praising the court for its decision, the applicant's attorney, Abdulfatai Abdulsalam, lamented the speed at which innocent Nigerians' fundamental human rights were being curtailed for unspecified reasons.

He advised the police to refrain from such actions in the absence of a valid invitation that would have authorised a search or legal arrest.
